WHEREAS Adam Travel Pty Ltd (“Adam Travel” or “us” or “we” or “our”) of 13 NERISSA GROVE, OAK PARK, VIC 3046, its officers, director, employees, servants and volunteers, is in the business of providing Hajj services and assisting Hajj Pilgrims to perform their Hajj Pilgrimage in Saudi Arabia
AND WHEREAS (the “client” or “Customer” or “you” or “I”) are entering into a legally binding Agreement with Adam Travel to provide you with the Services. Also, means a person or his representative who makes a booking for a Hajj Package with us.
"Supplier” means a third-party company or person who provides products, including a wholesaler of products such as (but not limited to) airlines, hotels, tour operators, food, beverages, transportation and car hire companies.
These terms and conditions apply to bookings you make with Adam Travel (instore, over the phone, by messages, or by email) as well as online bookings made via our website. These Terms and Conditions Agreement of Adam Travel Pty Ltd govern our relationship with you. Once we accept a booking from you on behalf of a Supplier, you will also have a separate contract with the Supplier, which will be governed by other Terms and Conditions. It is your responsibility to make yourself aware of those other Terms and Conditions.
By using the website of Adam Travel Pty Ltd to browse any Hajj Travel, Hajj Packages and Services you represent that you have read our (“Terms and Conditions Agreement”) posted on the website and you accept its full contents and applications to you. Furthermore, if any client proceeds with a booking on Adam Travel website, these (“Terms and Conditions Agreement”) will apply to that booking. Clients undertake to fulfil the obligations contained within these (“Terms and Conditions Agreement”).
Please read the following (“Terms and Conditions Agreement”) carefully. All bookings are made and accepted subject to these (“Terms and Conditions Agreement”).
These (“Terms and Conditions Agreement”) applies to all Adam Travel’s Hajj packages, in addition and without prejudice, to other specific conditions which may apply to particular Hajj packages. The (“Terms and Conditions Agreement”) – as defined below - apply to our services, directly or indirectly made available to you through whatever means, including online reservations.
The following constitutes a contractual agreement between Adam Travel Pty Ltd, hereinafter referred to as Adam Travel or us, and the purchaser of any of our Hajj packages, and hereinafter referred to as “client” or “Customer or You or I.” Acceptance of such agreement can be accomplished through a written signature on Terms and Conditions Agreement, or by submitting the (“Terms and Conditions Agreement”) online, or by submitting the Hajj Package Registration Form online or by paying the deposit for Hajj package which is purchased by one or more of Adam Travel Hajj packages. By purchasing a Hajj package or signing online and/or emails, messages, phone’s calls ….etc., our Terms and Conditions Agreement, the customer warrants:
All Hajj Packages, goods and travel arrangements remain property of Adam Travel Pty Ltd until invoices confirmation is paid in full.
Every effort is made to ensure website accuracy; however, Adam Travel cannot be held responsible for typographical errors, or errors arising from unforeseen circumstances.
Adam Travel reserves the right, at its sole discretion, to update, modify, amend, change, replace or remove any part or all parts of these (“Terms and Conditions Agreement”) at any time by posting updates, amendments, changes or replacing to our website. It is your responsibility to check this (“Terms and Conditions Agreement”) in our website page of use periodically for changes. Your continued use or access of the website following the posting of any changes will mean that you accept and agree to the changes. Also, while you completed the booking by paying the deposit payment of your Hajj package, it is your responsibility to check this (“Terms and Conditions Agreement”) in our website page of use periodically for changes and you accept and agree to the changes.
The (“Terms and Conditions Agreement”) – as may be amended from time to time – constitute the entire agreement and supersede any other agreements or understandings (oral or written), between you and us with respect to their subject matters unless explicitly stated otherwise.
By using Adam Travel’s online travel service Site you agree that, subject to certain rights and remedies you have under the Competition and Consumer Act 2010 (Cth) and similar State and Territory laws in Australia which cannot be excluded, restricted or modified, neither Adam Travel nor any Adam Travel subsidiary or related company or representative shall be liable for any loss, injury or damage to you or your belongings or otherwise arising in any way out of the provisions of travel services to you and Adam Travel excludes all other conditions and warranties implied by custom, law or statute.
EXECUTIVE SUMMARY:
Although you should read all of the Terms and Conditions Agreement of Adam Travel Pty Ltd, the following is a summary of the most important:
- Prices, including, in some cases, of confirmed bookings, may be subject to change.
- Some confirmed bookings are non-refundable if cancelled by you and it is your responsibility to check if this applies.
- We will be entitled to retain our service fees even if a booking is cancelled or does not proceed for any reason which is not our fault.
- It is your responsibility to make yourself aware of all information relevant to your travel plans, including but not limited to visa requirements and health precautions.
- We are not your agent and may receive additional fees or other incentives from Suppliers.
- We are not liable for the accuracy of any published Supplier content including websites and brochures.
- All Hajj packages that we quote on are subject to availability and may be withdrawn or varied by the Supplier without notice.
SUMMARY OF OBLIGATIONS
Before making a booking, it is important that you meet the following requirements:
- You are over the age of eighteen (18) and have sufficient funds to pay for the travel services.
- You have read Adam Travel Terms and Conditions Agreement and if booking for third parties warrant that you have their authority to do so and have conveyed these terms and conditions to them.
- You are responsible for checking the accuracy of all documents provided to you.
- You are responsible for confirming departure times of any booked services at least 24 hours prior to travel.
- You warrant and acknowledge that you have accessed the Smartraveller website http://smartraveller.gov.au for any specific information in relation to your intended destination.
- You accept that passports, visas, and other required identification documents are your responsibility.
RESERVATIONS AND DEPOSIT FEES:
- A deposit of $3,500.00 per person is required at the time of more than 150 days prior to departure for booking to secure your reservation. Your booking is not confirmed until the deposit is received by Adam Travel, and you receive written confirmation of your booking from Adam Travel.
- All deposits are non-refundable for changes of mind or cancellations by you (subject to your rights under the Australian Consumer Law).
- You will be required to pay a deposit (or deposits) when booking. The deposit amount varies depending on the Hajj Package booked and lead time to travel. In some instances, full payment is required at the time of booking and Adam Travel will advise the deposit amount at the time of booking. All deposits are non-refundable for changes of mind or cancellations by you (subject to your rights under the Australian Consumer Law).
- Payments made by direct deposit may take up to three business days to process. If you are paying by this method, you will need to make the payment at least three business days prior to the actual due date. You must notify Adam Travel of your payment once it has been made.
PAYMENTS:
- Progress payment of 45% of full payments at time of more than 120 days prior to departure
- Progress payment of 55% of full payments at time of more than 110 days prior to departure
- Progress payment of 65% of full payments at time of more than 100 days prior to departure
- Progress payment of 75% of full payments at time of more than 90 days prior to departure
- Progress payment of 85% of full payments at time of more than 80 days prior to departure
- Full payment required 70 days prior to departure
- Note: if any Customer makes a payment for Hajj reservation at the time of 120 days or less prior to departure, Customer must include any progress payments according to the above time schedule of progress payment.
- Any progress payment, it will be delayed more than 14 days from the due date, the booking will be cancelled automatic. This cancellation will be governed by the item of Cancellations (whether refund to client or the client pay to Adam Travel) which it has mentioned in the Terms and Conditions Agreement.
CANCELLATIONS:
- Cancellation received in writing 120 days or more prior to departure will be subject to non-refund (Nil Refund) of full the deposit paid.
- Cancellation received in writing 120 days or more than 110 days prior to departure date will be subject to no-refund of 40% of full package price excluded the deposit payments plus the deposit payment as mentioned in each package. These cancellation fees will apply and you will be required to pay to Adam such amount of the cancellation fees. In case you paid more, Adam Travel will refund the remaining balance after the deduction of cancellation fees.
- Cancellation received in writing 110 days or more than 100 days prior to departure date will be subject to no-refund of 50% of full package price excluded the deposit payments plus the deposit payment as mentioned in each package. These cancellation fees will apply and you will be required to pay to Adam such amount of the cancellation fees. In case you paid more, Adam Travel will refund the remaining balance after the deduction of cancellation fees.
- Cancellation received in writing 100 days or more than 90 days prior to departure date will be subject to no-refund of 60% of full package price excluded the deposit payments plus the deposit payment as mentioned in each package. These cancellation fees will apply and you will be required to pay to Adam such amount of the cancellation fees. In case you paid more, Adam Travel will refund the remaining balance after the deduction of cancellation fees.
- Cancellation received in writing 90 days or more than 80 days prior to departure date will be subject to no-refund of 70% of full package price excluded the deposit payments plus the deposit payment as mentioned in each package. These cancellation fees will apply and you will be required to pay to Adam such amount of the cancellation fees. In case you paid more, Adam Travel will refund the remaining balance after the deduction of cancellation fees.
- Cancellation received in writing 80 days or more than 70 days prior to departure date will be subject to no-refund of 80% of full package price excluded the deposit payments plus the deposit payment as mentioned in each package. These cancellation fees will apply and you will be required to pay to Adam such amount of the cancellation fees. In case you paid more, Adam Travel will refund the remaining balance after the deduction of cancellation fees.
- Cancellation received in writing 70 days or less days prior to departure date will be subject to non-refund (Nil Refund) of full package price (full payment). A 100% cancellation fees will apply and you will be required to pay to Adam Travel the full amount price of your Hajj package less any amount which you have already paid.
- If a booking is cancelled any non-refundable deposit or payment which you have paid will not be refunded and additional cancellation charges will apply under this Terms and Conditions Agreement.
- Be aware that some confirmed bookings are not refundable if cancelled, and also may not be transferable to another date or otherwise changed. Alternatively, a change may only be permissible subject to payment of an additional fee or charge. It is your responsibility to check if a booking is non-refundable or will incur charges for changing it before placing the booking.
- Changes and cancellations of confirmed bookings may incur fees from Suppliers in addition to our service fees. Suppliers’ fees are outlined in their relevant terms and conditions.
- If you change any aspect of your Hajj booking, we will do our best to accommodate your request, but it may not always be possible. All changes will be subject to any applicable travel service provider fees and Adam Travel change fees, and you will be responsible for any increase in pricing that may occur as a result of your change request.
- If you cancel any aspect of your Hajj booking, you will forfeit your deposit and you will be required to pay any applicable travel service provider fees and Adam Travel cancellation fees, and we will provide you with a refund for the remaining funds (if any).
- For instant purchase Hajj package, if you cancel any aspect of your booking, you will not be entitled to a refund your deposit, travel credit or other remedy from the travel service provider and/or Adam Travel.
INFORMATION:
Our responsibility is solely to arrange a booking of a Hajj Package in accordance with our packages. It is your responsibility to make yourself aware of all information that it is necessary or desirable to know in order to make optimum use of the Hajj Package and to undertake travel generally. We strongly recommend that you read our "Travel Information" which may be relevant, especially in relation to passport and visa requirements. Please note that this information is provided as a guide only, and although it is accurate to the best of our knowledge, we do not warrant that it is completely up to date at all times. Further, we do not warrant that it is comprehensive, and it may not address a topic that is relevant to your travel plans. It is your responsibility to further investigate and confirm any matters that are applicable to you.
HAJJ PACKAGES NOT INCLUDE:
- 15% VAT (GST) as per Saudi Government Regulations effective from 1st January 2020 and 5% Municipality Charges as per Saudi Government Regulations effective from 1st January 2019.
- Hajj cheque fee paid to the Unified Agent Office (about $850 approx.)
- Cost of Zabiha / Sacrifice (about $250 approx.)
IMPORTANT NOTICES AND CONDITIONS FOR ALL HAJJ PACKAGES:
- Prices are based on travel from Melbourne International Airport.
- Any additional charges related to stopover as requested by the client to other destinations other than Saudi Arabia, will be borne and paid by the client.
- Prices are based on airline fuel charge of September 2021. Clients are responsible for any major fuel surcharge.
- The amount of 15% VAT (GST) & 5% Municipality Charges” will be Added to Hajj package’s price. This is because all package prices EXCLUDE the “15% VAT (GST) & 5% Municipality Charges”.
- In the event of a pilgrim's death, all applicable costs, charges, and expenses will be borne and paid by the pilgrim's family or/and his insurance.
- Bus will be provided for transfer between Azizia, Haram and Mina camp but bus availability is subject to availabilities of the bus during 06 ZH to 14 ZH, traffic conditions and roads closure period which is controlled by Saudi Government Authorities. This service is not obligatory, and it is a compliment from our company. In case of non-availability of the bus, the pilgrim can use a taxi instead at his/her own cost.
- Bus will be provided for transfer between Azizia, Haram and Mina camp during 01 ZH to 5 ZH, the pilgrim who does not use the bus, he can use a taxi instead at his/her own cost.
- If the client would like to book a Quad, Triple or Double room, Client must have all numbers of persons who will be sharing and occupying the room in the submitted registration form. Adam Travel will assist the client to find another person or persons sharing the same category of the requested room (Quad, Triple or Double). In the case of Adam Travel not finding the person or persons sharing the same category of the client, the client must pay the full cost of the room that the client has selected in the registration form or client may change his category of room to another category (Quad, Triple, Double, Single room) and the balance of the cost as a result of an upgrade or change of room from one category to another category will be bearable and paid by the client.
- During Hajj the availability of a double room in the Standard packages are very rare, therefore there is no guarantee for the double room until we email you a final confirmation with the actual cost. In the meantime, whoever requested the double room first will be able to give it to them first. That is why some people are unable to receive a double room.
- No transfer/change from one package to another package will be allowed once you have booked your selected package.
- No transfer/change from one type of room occupancy (Triple to Quad, etc.) to another will be allowed once you have booked your selected occupancy and you receive a confirmation by email.
- Adam Travel has the right at any time during the Hajj season (before the arrival to Saudi Arabia) to change or replace any booking of a room or a hotel or airline, but must be matched or similar to the room or the hotel as mentioned on each Hajj package which is published on the website of Adam Travel Australia and according to the Registration Form and the (“Terms and Conditions Agreement”) which is completed and submitted by the client.
- You are solely responsible for ensuring that you hold all valid travel documents (passports, visas, etc.) and comply with the entry, exit, transit, or other requirements of the countries you are travelling to. You may refuse entry into a country if you do not have the required or valid travel documents. Adam Travel and our reservation staff will not be liable in any way for any consequences arising out of your not having the required or valid travel documents including visas approval or passport damage at any time.
- Please check your visa condition, passport, and your flights status before you fly to your destinations even in course of transit. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of any authorities will be your sole responsibility. We do not advise on any sort of visa information, details, rules and conditions about any country.
- Trip dates subject to change due to change in the Islamic calendar, Hajj ministry rules, airline policy or local delays within Saudi
- During the Hajj season, Hotel Management at Makkah, and Madinah, reconfigure the bed layout and the bed sizes in the hotel rooms to accommodate a large number of pilgrims. So, in some cases, the floor space will be tighter than what is shown on the hotel website.
- All prices are subject to availability and can be withdrawn or varied without notice. The price is only guaranteed once paid for in full by you. Please note that prices quoted are subject to change. Price changes may occur by reason of matters outside our control which increase the cost of the Hajj Package or service. Such factors include adverse currency fluctuations, fuel surcharges, taxes and airfare increases.
- The above Hajj package prices are calculated on 29/10/2021, as per the exchange rate of the Reserve Bank of Australia of Australian Dollar v/s USA Dollar (AU$1.00 = US$0.7546). Those prices of hajj package are subject to any changes (Down or Up) according to the rate of exchange on the day of 60 days prior to departure as the following:
- In case the rate of Australian Dollars goes up, Adam Travel will refund to the client the amount of difference between the exchange rate at the time of published the Hajj package on the website (29/10/2022) and the exchange rate on the day of 60 days prior to departure
- In case the rate of Australian Dollars goes down, the client will pay to Adam Travel the amount of difference between the exchange rate at the time of publishing the Hajj package on website (29/10/2022) and exchange rate on the day of 60 days prior to departure.
- Prices are based on the cost per ticket $2,000.00/ client (Melbourne-Madinah/Jeddah-Melbourne), any increase in price per ticket by airlines at the time of confirmation the ticket, will be borne and paid by the client.
- Adam Travel advised you that most airlines only provide free hotel accommodations for passengers that have a layover Only between 10-12 hours or overnight at any airport. However, each airline is different, so be sure to check your carrier's website. Therefore, Adam Travel are not responsible to provide any kind of free hotel accommodations for passengers than which it offers by your carrier's rules.
- The earliest check in for hotels is at 04:00 PM. If the client requests an extra night or extra hours in any hotel, in the case of early arrival, according to the name of the airlines’ and/or the availability of seats, the costs will be paid by the client upon his request according to the hotel’s availability and hotel rules.
- The latest check out hotels at 11:00 AM. If the client requests an extra night or extra hours in any hotel, in the case of lately departure, according to the name of the airlines’ and/or the availability of seats, the costs will be paid by the client upon his request according to the hotel’s availability and hotel rules.
- In case the Hajj package period ends earlier and you still have one or two nights before your flight departure date from Saudi Arabia to Australia as per availability and the rules of airlines company then you must check-out of the Makkah Hotel on the date which had been advertised in website and Adam Travel will book a room in a hotel in Jeddah for that extra one or two nights and the cost of such booking will be borne and paid by the you/client.
- The courier cost for sending and receiving the client’s passport and documents to the Saudi embassy in Canberra will be borne and paid by you/client.
- In the case of computer or human billing error or items that were forgotten to be addressed, we reserve the right to re-invoice passengers with correct billing at any time.
LUGGAGE:
- Adam Travel is not responsible for any lost or stolen luggage or personal items for the durations of any of our Hajj packages. Adam Travel cannot pay any compensation for any lost or stolen luggage including personal items under any circumstances during Hajj trip. It is the customer’s responsibility to take care of all personal and valuable items at all times. Adam Travel recommends customer purchase insurance to protect themselves should such a situation arise. Adam Travel is not responsible to transport or oversee the transportation of customer’s luggage.
- Adam Travel strongly recommends that you take out comprehensive travel and medical insurance at the time of paying a deposit. The policy should provide cover for loss of deposit, cancellation and additional expenses, medical expenses and repatriation and loss or damage to baggage and valuables. You are responsible for making any special or increased insurance arrangements which you deem are necessary.
- You will usually be permitted a free checked baggage allowance and a free cabin baggage allowance, the limits of which may differ by airline, class and/or route. The amount of checked baggage you are allowed depends on your class of travel/destination. Several leading carriers have now introduced additional charges for checked baggage on either a piece or weight basis. Please ask the airline for more specific information as these rules vary from time to time.
INSURANCE:
- It is your responsibility to arrange holiday insurance that is suitable for your needs, before you travel. It is also your responsibility to take your insurance policy documentation with you when travelling. We highly recommend that you purchase a comprehensive travel and medical insurance as soon as you have paid the deposit. It is your responsibility to ensure that the travel insurance is valid for the length and the destinations of your Hajj trip.
- YOU MUST HAVE TRAVEL INSURANCE WITH MEDICAL, EVACUATION AND REPATRIATION COVERAGE, covering all applicable dates of your travel with Adam Travel. This insurance must cover personal injury, emergency, and death medical expenses. You are strongly recommended to extend your coverage to include cancellation, curtailment, and all other expenses that may arise as a result of loss, damage, injury, delay, or inconvenience while traveling. You acknowledge that insurance coverage is not included in the cost of any package offered by the Adam Travel, and you are required to obtain separate coverage at an additional cost. It is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plans. You are responsible for advising your insurer of the type of travel, destination(s) and activities included in your booking so that the insurer may provide appropriate coverage
- Any person over the age of 45 years MUST provide his/her travel insurance before traveling.
HAJJ COVID REGULATIONS:
- The client understands that the government has imposed strict Covid related regulations. These regulations cannot be circumvented by Adam Travel, and all pilgrims must abide by them. Due to these regulations, all our programs are subject to changes and government mandates at any time. Restriction can include but is not limited to flight schedule, hotel occupancy, entrance into the KSA from certain embarking points, visa regulations, sightseeing, transportation occupancy, and type of transportation. In addition, there are restrictions on the number of times a pilgrim can perform Hajj, enter the Haram, or visit the Rawda. Pilgrims are advised to download all applicable apps such as Tawakalna and Etamarna. There are also different regulations depending on whether you enter with a Hajj visa. Adam Travel is willing to advise on differences between each, but due to the constantly changing nature of the regulations, cannot be responsible for cancelled activities that can be done with one visa and not the other.
- Should the client receive a positive Covid test prior to travel from Australia and forward the proper documentation, Hajj Visas including air and land bookings are fully non-refundable. The cost of cancellation of such booking due to a positive Covid test will be borne and paid by you/client or your insurance. Adam Travel will not accept any liability in these circumstances and no refunds or payment of any kind shall be given.
- Should The client receive a positive test in Saudi Arabia prior to their return, Adam Travel will work to change their return ticket with of charge. The cost of cancellation of such booking due to a positive Covid test will be borne and paid by you/client or your insurance. Adam Travel will not accept any liability in these circumstances and no refunds or payment of any kind shall be given.
- Should The client receive a positive test during their stay in Saudi Arabia, and the client stays in hospital, medication, and ambulance transportation. The cost of hospital, medication and ambulance transportation will be borne and paid by you/client or your insurance. Adam Travel will not accept any liability in these circumstances and no reimbursement or payment of any kind shall be given.
- However, any additional expenses including but not limited to hotel expenses and meals will be the responsibility of the client. Programs may be cancelled unexpectedly due to government regulations or airline regulations. Adam Travel cannot be held responsible for changes of this nature. All Hajj packages are subject to travel mandates, restrictions and regulations and may change at any time. These are not only limited to entrance into KSA from specific countries, proof of vaccination, COVID-19 rules and regulations, limitations on occupancy in hotels, limitations to dining in restaurants, limitations on movement within Saudi Arabia, limitations on entering Haram and limitations on performing more than one Hajj, limitations on age, etc.
- All travellers regardless of age must be fully vaccinated. Based on current vaccination protocols 12 years old and above ONLY are eligible.
- COVID-19 remains a risk in Saudi Arabia. Monitor your health closely and follow the advice of local authorities. Travellers to the Kingdom must have medical insurance that covers the cost of COVID-19 treatment.
- Breaching COVID-19 Saudi’s restrictions may result in significant fines and imprisonment. These restrictions are subject to change at any time. Check with local authorities for the latest directives and follow their advice.
- You must purchase your policy more than 21 days ahead of your departure date to take advantage of the pre-trip COVID cancellation and amendment benefits, where you or your travelling companion have COVID-19 and cannot travel.
- Some travel insurers in Australia now offer limited cover for COVID-19. It will likely only cover medical, quarantine and cancellation costs if you test positive to COVID-19. But travel insurance is unlikely to cover cancellation if you’re not able to travel due to lockdowns at home or your planned destination. - If you or someone in your immediate travelling party tests positive for COVID-19, you should isolate immediately and contact the local health authority for advice on what to do. You should also contact Adam Travel and also seek advice from your travel insurer.

In order to make your Hajj application please ensure the following items have been submitted:
- Valid Australian passport for at least 8 months at the time of departure from Australia with 4 empty pages.
- Six passport size photos (white background).
- Saudi Arabia Visa Application Form for Each Person (Download from Website, Fill, Print & Sign it).
- In case of non-Australian passport, the applicant must provide a copy of Visa Entitlement Verification Online (VEVO), to approve that the applicant has a Residents in Australia at least for 2 years.
- Original certificate of Vaccination for Meningitis (ACYW 135) and Seasonal Flu vaccine.
- PCR test at any Australian airport 7-24 hours before your departure from Australia “https://www.histopath.com.au/locations/airport”.
- Original certificate of Vaccination for COVID-19 with complete doses.

- Females of age above 45 can be traveling without a Mahram but she must perform Hajj with a group.

- A Mahram must be a minimum 17 years of age.
- Age Limit: Ages 12 and above will be allowed for this year of Hajj.
- Ages 12 and below please call the office.
- Any supporting documents required by the Saudi Embassy must be duly certified by Police.
- Prepaid self-addressed Courier Bag or Australian Express post Platinum envelope (Maximum Weight of no less than 500g, Maximum Thickness 20mm) for us to return your Passport and other documents in relation to your travel. Alternative arrangements of returning your documents can be made at your own expense.
- If requested by relevant authorities to use air-courier for passport and Hajj documents to obtain Hajj visa between Melbourne and Canberra and between Canberra and Melbourne (2 way), the cost of the air-courier will be borne and paid by the client which is AU$165.00.
INFANT AND CHILD POLICY:
- Children 2 years and over will be considered as an adult, and he will be charged full amount of Package price.
- Infant under 2 years will subtract 25% of full amount of Package price.
PROCESSING OF APPLICATION:
- Adam Travel is an IATA agent who has entered into contract arrangement with Saudi Arabian authorised providers licensed to provide accommodation, transportation and other services to pilgrims entering Saudi Arabia for Hajj.
- All documents are thoroughly checked by Adam Travel, to ensure that all the requirements are complied with. We will forward and hand deliver to the Embassy of Saudi Arabia in Canberra for assessment and processing of visa.
- Processing normally starts One (1) month prior to departure date, unless otherwise advised by the Embassy for another time processing. We are responsible for the submitting of your visa application.
- Adam Travel will follow-up with the Embassy on your behalf.
- In the event of any or further documentation be needed in the course of visa processing, Adam Travel will advise you accordingly.
- As Adam Travel has a large volume of pilgrims and documents to process, please assist and cooperate with us by keeping your contact to URGENT MATTERS ONLY until processing is completed and documents are returned to you accordingly.
CONDITIONS OF TICKETS BY AIRLINES
- Tickets are issued 30 days prior to departure.
- Prices are based on the cost per ticket $2,000.00/ client (Melbourne-Madinah/Jeddah-Melbourne), any increase in price per ticket by airlines at the time of confirmation of the ticket, will bear and paid by the client.
- Name correction will incur AU$550 fee.
- Date change by revalidation after ticketing AU$550 fee.
- Ticket reissue fee AU$550.
- Clients who no-show for a flight will be considered as cancelling after departure and NIL refund will apply.
- Seats are subject to availability at time of booking. No guarantee on confirmation of seats at group fare level on high demand flights. We have no control over the airlines’ allocation of seats and so, if you have particular seat requests, you should check-in at the airport as early as possible. We cannot guarantee that these requests will be met.
PASSPORTS AND VISAS
- It is your responsibility to review, check and make sure that the informations and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies.
- It is your responsibility to fulfil the passport, visa details and other immigration requirements applicable to your itinerary and airline tickets details.
- The name provided by you for your travel airline tickets must be the same as that in your passport. It is your responsibility to check your name and ensure that you have all the documentation you need for your journey. Visas are obtained from the issuing authority in Australia and you should confirm these with the relevant High Commissions, embassies and/or consulates. Visa requirements vary by both country you are travelling to and the current citizenship you hold so please ensure you check well in advance of your travel dates to allow sufficient processing time as required by the embassy. Either airline staff or immigration authorities may not allow you to pass through customs and board your flight without the appropriate visa and some countries will not allow you to enter without proof of a return or onward electronic or paper ticket. Airline check in staff at your point of origin may deny boarding you. We do not accept any responsibility in the case you being unable to travel due to not complying with such requirements. Therefore, you accept full responsibility for obtaining all such documents, visas and permits prior to the start of the trip, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by the Adam Travel that is a direct result of your failure to secure or be in possession of proper travel documentation. Adam Travel Pty Ltd does not provide advice on travel documents and makes no representations or warrantees as to the accuracy or completeness of any information provided on visas, vaccinations, climate, clothing, baggage, or special equipment and you agree that the Tour Operator is not responsible for any errors or omissions in this information. If your trip is cancelled due to you not comply with visa details, rules and conditions, Adam Travel will not be liable for any costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever in such circumstances.
- Adam Travel will apply for a Hajj visa and submit all relevant documents to the relevant Saudi authorities. Adam Travel cannot guarantee to obtain your Hajj visa. If Saudi Foreign Affairs issued your visa, you must pay the total fees of your Hajj package agreed upon between Adam Travel and you. Suppose Saudi Foreign Affairs or Saudi Consulate in Australia refuses your Visa. In that case, you must pay the fees already involved to relevant Saudi authorities, including Adam Travel’s services fees. The client will pay these fees according to Cancellation rules mentioned in Adam Travel’s Hajj Terms and Conditions Agreement. Adam Travel acts as an agent, and Adam Travel does not accept any responsibility in case Saudi’s relevant authorities refuse your Visa. Adam Travel will hold your original documents, including your passport or travel documents until you pay the total cost mentioned above due to the Saudi authorities’ refusal of your visa.
BOOKING ON BEHALF OF OTHERS
- By booking on behalf of other participants, you are deemed to be the designated contact person for every participant included on that booking. This means that you are responsible for making all payments due in connection with your trip booking, notifying the Adam Travel if any changes or cancellations are required and keeping your party informed.
- By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and Adam Travel will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.
YOUR BEHAVIOUR
- It is your responsibility to ensure that you and the members of your group do not behave in a way which is inappropriate or causes danger, distress, offence or damage to others or which risks damage to property belonging to others (including but not limited to drunkenness and air rage) whilst on your trip.
- If, in our reasonable opinion or that of our Suppliers, your behaviour is inappropriate and causes danger, distress, offence, or damage to others, or risks damage to property belonging to others, we and/or our Suppliers (e.g. hotel managers, airline pilots) may take appropriate action in order to ensure the safety and comfort of our customers and their property and that of our Suppliers, including terminating your trip, in which case our and our Supplier's responsibility to you will cease immediately and you will not be eligible for any refunds, payments of compensation and/or any reimbursement of any cost or expenses you may incur as a result of such termination. Further, you will be liable to reimburse us for any expenses we incur necessarily as a result of such termination.
UNAVOIDABLE OR EXTRAORDINARY CIRCUMSTANCES
- In the event of unavoidable or extraordinary circumstances, a travel service provider may materially modify or cancel your Hajj booking as set out below.
- In these Booking Terms and Conditions “unavoidable or extraordinary circumstances” means any cause outside a travel service provider’s reasonable control which could not have been prevented or avoided even if all reasonable measures had been taken by the travel service provider (including, but not limited to, war, threat of war, riot, civil disturbances, industrial dispute, terrorist activity and its consequences, plague, epidemic, pandemic, infectious disease outbreak or any other public health crisis (including quarantine or other employee restrictions), natural or other disaster (such as volcanic ash or hurricanes or similar events), nuclear incident, fire or bushfires, adverse weather conditions (actual or threatened, including snow and fog), closed or congested airports or ports or other modes of transport, unavoidable technical problems with transport, unforeseen alterations to transport schedules, transportation disruptions or cancellations, domestic and/or international travel restrictions, changes to travel advisories and restrictions, changes to health advisories and quarantines, political issues, Saudi government decision to cancel Hajj, airline decision to cancel the flights and similar events).
- A material modification is one that has a serious impact on your booking and would cause substantial inconvenience to you (including a change of departure date, departure point or airport, or change of departure time of more than twelve hours or cancel your Hajj trip).
TERMS AND CONDITIONS AGREEMENT
- Adam Travel express reserves the right to amend or change all or any part of these (“Terms and Conditions Agreement”) at any time without prior notice. If we do amend these Terms and Conditions Agreement, the amended (“Terms and Conditions Agreement”) will be effective when posted on this website and you are deemed to have accepted the relevant changes.
- When you book with Adam Travel the (“Terms and Conditions Agreement”) become a part of your booking.
- By accessing, browsing, or making a reservation through this website, you expressly accept these (“Terms and Conditions Agreement”), and intend to be legally bound by you. To the extent any Hajj travel products and/or services are booked through your Agent or Adam Travel, you agree that these (“Terms and Conditions Agreement”) apply to all transactions. Please read these (“Terms and Conditions Agreement”) carefully. If you do not accept all of these (“Terms and Conditions Agreement”), please do not use the website, or make any reservations through your Agent or Adam Travel.
- These (“Terms and Conditions Agreement”) and your use of the Adam Travel website will be governed by and construed in accordance with the laws of Victoria, Australia and you hereby submit to the jurisdiction of the courts in that place.
EXCLUSION OF LIABILITY AND INDEMNITY:
- The responsibility of Adam Travel as the tour operator or their agents is limited.
- We act as an agent for and sell various travel related Hajj packages as an agent on behalf of numerous transport, accommodation, and other service providers, such as airlines, coach, rail, and cruise line operators, as well as travel wholesalers (“Suppliers”). We may receive fees, commissions, gifts, or financial incentives from Suppliers in respect of Hajj packages we advise you of or arrange on your behalf. Any brochures provided by us to you are supplied by Suppliers or are prepared by us based on content supplied by Suppliers, and we accept no liability for errors in that material. Your oral or written instructions to us are authority for us to make travel bookings on your behalf and to arrange relevant contracts between you and the applicable Supplier. Notwithstanding this authority, we are not your agent and do not have any fiduciary duty to you. We exercise care in the selection of reputable Suppliers, but we are not ourselves a provider of travel services and have no control over, or liability for, the Hajj Packages provided by the Suppliers, who are third parties. All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by the Supplier. We recommend that you read them before finalising the transaction and we can provide you with copies of the relevant terms and conditions on request.
- Your legal rights and remedies in connection with the provision of Hajj packages are against the Supplier and, except to the extent a problem is directly and primarily caused by fault on our part, are not against us. Specifically, if for any reason (excluding fault on our part) any Supplier is unable to provide the Hajj package for which you have contracted either at all, or to the requisite standard, your remedies are against that Supplier and not against us.
- Before booking your Hajj package, you should read this (“Terms and Conditions Agreement”) and any additional terms and conditions carefully and ensure that you understand ALL of the Terms and Conditions Agreement.
- All information and other content on this website is provided "as is" and without warranties of any kind, either express or implied. Adam Travel (and its suppliers and licensors) expressly disclaim all warranties of any kind including but not limited to implied warranties of merchantability and fitness for a particular purpose.
- Your continued use of Adam Travel website or the services including emails, messages, phone’s calls ….etc, will mean that you accept unconditionally any amendments made to the Terms and Condition Agreement, (“Hajj Registration Form”) and the contents of the Hajj packages including prices.
- Authority to Adam Travel under the Privacy Act 1988 (Cth) ("Privacy Act"): To provide you with Hajj travel services, Adam Travel needs to: collect personal and others information about you to exchange it with airlines, hotels, and any other suppliers providing travel related Hajj services , and you agreed in relation to handling this personal information. If you do not provide the information requested, Adam Travel may not be able to provide you with Hajj travel service.
- The services sold through Adam Travel are subject to availability and can be withdrawn without notice. Access to this website and any website normally linked to this website is not guaranteed and is subject to availability of communication links and access rights.
- We do not accept any responsibility if you cannot travel or incur any other loss because you have not complied with any passport, visa, immigration requirements health formalities or any other reasons. You agree to reimburse us in relation to any fines or other losses which we incur as a result of your failure to comply with any passport, visa, immigration requirements or health formalities.
- Adam Travel reserves the right to vary published rates in the event of changes in exchange rates or price rises made by wholesalers or other suppliers. If the cost of any service increases due to exchange rate fluctuations, price increases, tax changes or any other reason, you must pay the increase when notified. Adam Travel is not liable in any way if any increase occurs.
- Adam Travel does not warrant that any of the functions contained on this website or your access to this website will be uninterrupted or error-free, that any defects will be corrected or that this website or the server on which this website is stored are free of viruses or any other harmful components. - When applicable, your booking agent is any travel agent or other company, organisation, or person who, without being a party to the contract between you and us, is acting as an intermediary to handle bookings and payments for the package which you book with Adam Travel. Please note that Adam Travel cannot accept any liability for the acts, omissions, or representations of any booking agent. Please note any Terms or Conditions Agreement which the booking agent has given to you does not incorporate into Our (“Terms and Conditions Agreement”) or form any part of the same and in all cases our (“Terms and Conditions Agreement”) shall take precedent.
- Services and goods provided during the Hajj trip, service charges and any airport charges and taxes which are not included in the confirmed Hajj package price must be paid by you. Adam Travel may at its discretion charge service fees on your booking.
- Adam Travel reserves the right at any time, in its sole discretion, to amend, modify, or alter the Adam travel website, terms and condition agreement, registration form and the contents of Hajj packages as described in website without notice by posting the amended terms and condition agreement, registration form and Hajj packages on this website. The amended of terms and condition agreement, registration form and Hajj packages shall be effective from and after the date that they are posted on the website. Therefore, each time you access the website, you need to review these terms and condition agreement, registration form and the contents of the Hajj packages periodically.
- Adam Travel Pty Ltd (Australia) and its related companies have various subsidiaries, branches, and offices throughout the world. The subsidiaries, branches and offices only provide an internal supporting role to and for the benefit of Adam Travel Pty Ltd (Australia). These subsidiaries, branches, and offices (as well as any other affiliated companies) do not have any power or authority to render the service, to represent Adam Travel Pty Ltd (Australia) or to enter into any contract in the name of, for or on behalf of Adam Travel Pty Ltd (Australia).
- Hajj’s procedures and requirements may change at any time with or without notice by Saudi Government. Adam Travel visa service allows applying on your behalf for Hajj visas to relevant Ministry of Hajj, Ministry of Foreign Affairs, Embassy or Consulate of Saudi Arabia. Adam Travel is unable to guarantee to obtain Hajj visa and consequently, Adam Travel accepts no liability whatsoever for not obtaining Hajj visa with or without reasons. Adam Travel will not be responsible for any damage or loss of your passport during the whole period of Hajj process from the time of submitting the passport to Adam Travel until the return back from Saudi Arabia. Adam Travel reserves the right to claim any associated costs incurred as a result of not obtaining Hajj visa. In this case, the client bears the cost of package, hotel, and ticket cancellation fees. Adam Travel is also not liable for any delay, misplace or loss of passport during processing and obtaining Hajj visa from relevant Embassy or Consulate of Saudi Arabia.
- All bookings made on this Adam travel website are subject to the relevant supplier's/tour operator's booking conditions in addition to these Adam travel Term and Conditions Agreement.
- Adam Travel makes no representations or warranties of any kind with respect to flights for Hajj packages including not enough time to perform 40 Salaat in Madinah. All hotels star rating is according to Saudi Arabian standard. Due to circumstances beyond the control of Adam Travel may also need to cancel or modify events that appear in the itinerary. There may be other circumstances in which hotel changes become advisable or necessary. Therefore, Adam Travel also reserve the right to substitute any of the hotels. During Hajj journey the unexpected is often the norm. Despite very careful planning and organization the Hajj journey can never be taken for granted like a normal holiday expected in Australia.
- The provision of the service offered by the company is in good faith and best endeavours to meet your standard, however, Adam Travel, our agents, travel partner or their sub agents cannot be held responsible for any shortcomings outside the company’s control against your expectations of the pilgrimage. No express or implied, is made by us or by any person as to its accuracy, completeness or fairness and it should not be relied on as such. Any opinions and estimates expressed reflect our judgment at this date and are subject to change without notice.
- Adam Travel are not always in a position at the time of booking to confirm the actual carrier, aircraft type and timings in respects to your flight, Adam Travel shall only confirm this information as soon as Adam Travel have confirmation of this from the airlines. The actual timing of your flights and information relating to the flight will be on your ticket which will be emailed prior to travel which may include you receiving the ticket on the day. It should be noted that airline times and details for the flight may change even after a ticket is emailed, if this occurs Adam Travel will contact you as soon as possible. Any changes in the flight which are out of our control will not be our responsibility and Adam Travel shall not be liable for the same.
- When you make your booking with Adam Travel, you acknowledge there is an element of risk associated with pilgrimage generally, particularly in Saudi Arabia during Hajj season. These include overcrowding in hotels, on all forms of transport and poor management of public places. These risks can also include the risk of injury or illness in remote places without medical facilities. You must be fit enough to undertake the pilgrimage and you must exercise reasonable care for your own safety and the safety of other members in your Group.
- You acknowledge that Adam Travel have the right to receive commissions for Hajj travel service to confirm your travel bookings made through this website or by emails, messages, phone’s calls ….etc.
- You agree to release and forever discharge Adam Travel from any and all actions, causes of action, claims, and demands for, upon, or by reason of any damage, loss or injury, to me and your property which may be sustained in consequence of the losses and expenses as aforementioned.
- In case you/the client fail(s) to pay any outstanding payments to Adam Travel then he/she will be liable to face court proceedings in Melbourne, Victoria and all the expenses incurred in such recovery of dues including legal fees, lawyers’ fees, barristers’ fees and Adam Travel staff's fees (Hourly Rates) who will be involved in such case will be borne by you/the client, and you/client confirms and agrees to pay such costs and fees.
- Adam Travel will not take any responsibility for ensuring successful booking if any travelling documents are not so received, and/or are inaccurate, nor will it refund any monies paid in respect of your booking(s).
- You are responsible to maintain acceptable standards of behaviour at all times. You must not behave in any way, which causes or may cause distress, injury, or annoyance to others, or give rise or may give rise to the risk of damage to property. If you do behave in any such way, you are likely to be evicted from your hotel. In case of such eviction, the evicting authority’s decision will be final, and Adam Travel will have no liability to you, and will not refund to you any portion of the cost of your package, nor will Adam Travel make alternative arrangements for you.
- Adam Travel shall not be liable for any personal injury. For those under medication, please note that medicines can be expensive or unavailable in Saudi Arabia. Adam Travel advise you to take sufficient supplies to last you the full duration of the Hajj journey. Adam Travel also recommend that you take medication for coughs, colds and painkillers from Australia. Adam Travel are legally obliged to advise you to take out adequate travel/health insurance. Travel/health insurance is not included as part of your Hajj travel package, and it remains your responsibility to purchase travel/health insurance separately. You must be satisfied that your insurance fully covers all your personal requirements including cancellation charges, medical expenses, pre-existing medical conditions, and repatriation in the event of accident, illness, or death. If you choose to travel without adequate insurance cover, you do so entirely at your own risk and Adam Travel will not be liable for any losses whatsoever, in respect of which insurance cover would otherwise have been available.
- Adam Travel are not responsible for excessive, loss or damaged luggage, or for any personal belongings including cash, passports, phones, and bank cards etc. carried by you. It is your complete responsibility throughout your journey. This includes air transfers, coach travel etc. Adam Travel will not take any responsibility for safeguarding the property of individuals at any time during your journey nor for any loss or damage of any property. Luggage allowance is as per the airline rules and conditions and Adam Travel are in no way responsible for this. It is your duty to check for baggage allowance and ensure that you are carrying permitted items as per the airline/airport rules and regulations.
- As is the nature of Hajj with the vast number of pilgrims, there is a higher probability of viruses and airborne diseases, it is therefore your own personal responsibility for your Well-being at all times, Adam Travel cannot be held responsible for any personal accidents, illness, and death during your travel. Adam Travel strongly advise you have suitable travel/health insurance cover for your journey and stay.
- In the case of death overseas during Hajj trip and you haven’t obtained a comprehensive travel and health insurance prior to travel, your family and/or your inheritors will have a difficult time as they are responsible and liable to pay such fees and expenses of the sickness and/or death from your inheritance or from their money/assets and Adam travel doesn’t accept any responsibility and liability in these circumstances including any kind of payments related to the sickness and/or death.
- When you arrive at the KSA, before being allowed access on to the buses provided by the MOH, you must give your passports to the Saudi authorities for safe keeping when requested to do so. Please note that this is a stipulation of the MOH and it is not something over which Adam Travel have any say or control. Adam Travel cannot accept liability for any loss or damage to your passport whilst it is in the possession of the MOH. You accept that failure to provide your passport to the authorities when requested to do so will mean that you will not be allowed to board onto the buses to continue on your journey. Adam Travel will not accept any liability in these circumstances and no refunds or payment of any kind shall be given.
- Where you are on Hajj, your itinerary will be governed by the Islamic calendar, the Saudi authorities and the MOH. Therefore, your itinerary is subject to change at all times, and you confirm that Adam travel cannot accept any liability in these circumstances. Furthermore, due to the nature of Hajj pilgrimage, your itinerary is on a very tight schedule, when told by your group leader and or itinerary you must ensure that you are at all departure points at the times specified in order to commence the next stage of the pilgrimage. Failure to be present at the departure points at the times specified means that the group may leave without you and Adam travel cannot accept any liability for this.
- It is your own responsibility to complete the Hajj pilgrimage. Adam Travel will endeavour to provide guidance and assistance when and where possible. You are expected to have necessary knowledge and understanding on how to perform and or complete the Hajj pilgrimage. Any booklets or information on how to perform Hajj Adam Travel may provide you with is a guide only. The actual time it may take you or your group to complete the Hajj pilgrimage will depend on your own individual performance. Adam Travel will not accept any liability and or responsibility for any delays, changes or your and your group inability to complete all necessary rituals for Hajj as a result of your own acts or omissions.
- Hajj travel procedures and requirements may change at any time with or without notice by the Saudi Government. The Customer must comply in full faith with all such new requirements, regulations, laws, and rules. If the Customer fails to make full disclosure of such new requirements, regulations, laws, and rules, in this case the Customer bears the full cost of Hajj package and ticket cancellation fees. Adam Travel visa service allows applying on your behalf for Hajj visas to relevant Embassy or Consulate of Saudi Arabia. Adam Travel is unable to guarantee to obtain Hajj visas and consequently, Adam Travel accepts no liability whatsoever for not obtaining a Hajj visa with or without reasons. Adam Travel will not be responsible for any damage or loss of your passport during the whole period of Hajj process from the time of submitting the passport to Adam Travel until the return back from Saudi Arabia. Adam Travel reserves the right to claim any associated costs incurred as a result of not obtaining Hajj visa. In this case, the Customer bears the full cost of Hajj package and ticket cancellation fees. Adam Travel is also not liable for any delay, misplacement, or loss of passport during processing and obtaining Hajj visa from the relevant Embassy or Consulate of Saudi Arabia.
- All bookings made on this Adam travel website are subject to the relevant supplier's/tour operator's booking conditions in addition to these Adam travel Term and Conditions Agreement.
- Accommodation star ratings are provided by the accommodation according to the Saudi Commission of Tourism & National Heritage and are quoted for guidance only; these are Saudi Arabian rated which are not necessarily the same as Australian ratings & subject to change. You accept that accommodation may be of a lower standard than that expected.
- Adam Travel makes no representations or warranties of any kind with respect to flights for Hajj packages including not enough time to perform 40 Salaat in Madinah. All hotel star rating is according to Saudi Arabian standard. Due to circumstances beyond the control of Adam Travel may also need to cancel or modify events that appear on the itinerary. There may be other circumstances in which hotel changes become advisable or necessary. Therefore, Adam Travel also reserves the right to substitute any of the hotels and transportations. Also, In case Adam Travel upgrade hotels or transportations for any packages, Adam Travel reserves the right to collect the cost of upgrading and the cost of such upgrading of hotels or/and transportations will be borne and paid by the you/client. During the Hajj journey the unexpected is often the norm. Despite very careful planning and organization the Hajj journey can never be taken for granted, like a normal holiday expected in Australia. The Pilgrim wishes it to be pleasant for a once in a lifetime experience, however the vast number of people from across the globe with a varied lifestyle may have an impact on your pilgrim, unfortunately the company cannot be held responsible for this experience. It is noteworthy that all pilgrims must wear Ihram and is obligatory to be worn on Miqat or to the point confronting Miqat. It is not permissible to step forward towards Makkah without Ihram beyond Miqat or the point confronting Miqat. If anyone does so, he will be under obligation to offer Dam. Ihram is not required for travelling to Madinah.
- Changes in fees (including fuel costs, dues, taxes, fees such as landing taxes or embarkation/ disembarkation fees at ports/airports, transportation costs and exchange rates) and services mean that the price of your confirmed Hajj travel package is subject at all times to the above variations. Such variations could include but are not limited to cost changes which are part of our contracts with Third Party suppliers. Therefore, Adam Travel reserve the right to amend the price of any packages at any time.
- In the unlikely event Adam Travel is unable to meet your requirements through our normal booking process; we will let you know. If you wish us to continue with the travel booking, any additional costs as notified to you, such as telephone and other communication expenses, courier charges, any associated bank costs for urgent remittance of funds, etc. will be payable by you, the customer.
- Acknowledgment of your travel booking will be made through the invoice via email including or excluding the special requests (requirements) which were made earlier by you or your agent. The fares shown on this website can be purchased only in conjunction with the website. Adam Travel issue you an invoice as a confirmation for your booking (albeit we reserve the right to decline your booking and return your deposit at our absolute discretion).
- You acknowledge that Adam Travel have the right to receive commissions for Hajj travel service to confirm your travel bookings made through this website.

Due to the ever-growing Muslim population, the Holy Mosques and the cities around them are constantly under maintenance and construction. Adam Travel cannot be held liable for any impact this may have on your expectations and or experience of your pilgrimage. The provision of the service offered by Adam Travel is in good faith and best endeavours to meet your standard however, Adam Travel, our agents or their sub agents cannot be held responsible for any shortfalls outside Adam Travel’s control against your expectations of the pilgrimage.
- In case of Hajj pilgrimage being cancelled by the Saudi Government or the cancellation of overseas travel by the Australian Government due to any contingency like war or disease, etc., and the subsequent refusal by the airlines, hotels, etc., to refund the booking payments made to them by Adam Travel as part of the current year's Hajj booking and they decide to move these payments for the following year. Then Adam Travel will also move your payments including any deposits paid by you to earliest available year's Hajj booking which it will be run by Adam Travel. If you attempt to cancel your Hajj, Adam Travel is in a position to not refund the deposit payment which is $3,500. Therefore, you must pay Adam Travel the difference of the balance if your payments as deposit is less than $3,500 of the required deposit to cover all loses due to such cancellation of your hajj booking.
- In case of Hajj pilgrimage being cancelled by the Saudi Government or the cancellation of overseas travel by the Australian Government or due to any contingency like war or disease, etc., and the subsequent refusal by the airlines, hotels, etc., including “unavoidable or extraordinary circumstances”, therefore, Adam Travel will move your payments including deposit which paid by you to only the following first available Hajj’s year/years by Adam Travel. If you attempt to cancel your Hajj, Adam Travel is not refunding the deposit payment which is $3,500, Adam Travel will refund only the payments which is more than the deposit payment (any remaining payment in our account more than $3,500.00, if any). In the case that your deposit payment was less than $3,500.00, then you must pay Adam Travel the amount difference between your deposit payment and $3,500 which was the required as a deposit to cover all loses due to such cancellation of your hajj booking. Adam Travel cannot control and will not have any responsibility for such cancelation, and you cannot claim or demand the deposit payment to refund, and you admitted and confirmed that you are not taken any kind of legal action against Adam Travel under such circumstances. Furthermore, you agree to release and forever discharge Adam Travel from any and all actions, causes of action, claims, and demands for, upon, or by reason of any damage or losses sustained in consequence of the losses and expenses as aforementioned.
- The provision of the service offered by the company is in good faith and best endeavours to meet your standard, however, Adam Travel, our agents, travel partner or their sub agents cannot be held responsible for any shortcomings outside the company’s control against your expectations of the pilgrimage. No express or implied, is made by us or by any person as to its accuracy, completeness or fairness and it should not be relied on as such. Any opinions and estimates expressed reflect our judgment at this date and are subject to change without notice.
- Adam Travel acts only as an agent for clients in making arrangement of services for airlines, hotels, transportations, or any other services in connection with this tour and assumes no liability or responsibility whatsoever for mismanagement from any one of the administration, management or employee/staff who provide any of these services. Adam Travel will not be liable to the client for any claims against non-fulfilment, unsatisfactory or non-performance of services and Hajj Packages purchased on the client’s behalf by the company from third parties such as (but not limited to) airlines, hotels, tour operators, car hire companies. Adam Travel makes every effort to ensure that all the arrangements and services connected with a client’s tour will be carried out as specified in the most efficient and effective way possible. Adam Travel will assist the client during his/her tour to solve any issue or complaint between him/her and third parties such as (but not limited to) airlines, hotels, tour operators, car hire companies. However; Adam Travel does not have direct control over the provision of services by suppliers and, whilst they are in all cases selected with the utmost care, Adam Travel does not accept liability for the errors and omissions of such suppliers.
- In the KSA, the Saudi government has the sole responsibility for the movement of pilgrims between Jeddah, Makkah, Mina, Arafat, Muzdalifah, Madinah or any other point of pilgrimage in the KSA. Our Local Agent has no control whatsoever over the transportation, this includes and not limited to, timing, quality of the transport, duration of the journey, facilities for the transport. Our local agent will assist where possible, but this element of the pilgrimage is outside of our control and cannot be held responsible in any shape or form. Furthermore, the Saudi government requested that all pilgrims who will depart from Jeddah or Madinah airports must arrival to Jeddah or Madinah airports at least 12 hours prior before take-off. Also, the government authority will handle the pilgrims’ passports in the bus and the buses can depart from the hotel to the airport only by the permission of Saudi government authority according to the schedule of their airline departure from Saudi Arabia.
- Transport within KSA is provided by, controlled and governed by the MOH and Adam Travel have no control over this. Transport might be delayed or changed at little, or no notice and you accept that Adam Travel have no control over such delays or changes nor can Adam Travel accept any liability for this. Furthermore, you accept that the road network system in Saudi Arabia is developing, and its infrastructure may not be as you are accustomed to within Australia.
- The Ministry of Hajj and others related authorised government bodies in KSA are solely responsible of moving all Hajj Groups from Madinah to Makkah or Azizia or Shisha or Gabel Alnour by supplying our Hajj group's buses along with the group's related passports. There may be a change in this itinerary schedule procedure of Hajj trip by one or two days (earlier or later), due to change of Islamic Hijri calendar dates by Saudi Arabia or/and due to the delays of supplying such buses or/and passports. In both cases of earlier or later departure from Madinah, there will be no refund of any cost paid by the client. In case of delay, Adam Travel will arrange for the extra days stay in the same or another hotel in Madinah and the additional cost of such day(s) will be borne and paid by the client. At the same time, the period of stay in Makkah/ Azizia/ Shisha/ Gabel Alnour will be reduced and there will be no refund to the client as the accommodation cost has already been paid and there is no refund to Adam Travel as per hotel booking rules in Saudi Arabia. Adam Travel cannot control and also will not have any responsibility for such delays and the client cannot claim or demand any refund and the client admitted and confirmed that he/she is not allowed to take any kind of legal action against Adam Travel under such circumstances.
- The KSA has the sole responsibility of Tents in Mina & Arafat; our local agent will assist where possible; Adam Travel cannot be held responsible for the quality or services at these points in the pilgrimage. Specialized Mina and Arafat services are based on Saudi Authority's approval.
- Adam Travel is an international organisation, while any Hajj Group arrives to Saudi Arabia without any further notice by Adam Travel, the administration staff of Adam Travel in Saudi Arabia can be changed any Hajj Group name which had been advertising in Australian website to another or different name of Hajj Group. As a result, if any Hajj Group name from Australia cannot reach the full capacity of 48 persons per bus, therefore such group name will be join with any other international hajj groups of Adam Travel with same or different name of Hajj Group but must be with same package itinerary as the original Hajj Group name which is advertised in Australian website. The client confirmed that he/she cannot object or claim any payment for such issue and also he/she cannot take any legal action against Adam Travel.
- The Hajj Group Leader or Imam assigned to any Hajj Group may be of a different nationality than Australian.
- The director and administration staff of Adam Travel in Australia are not necessary to be present for a part or whole duration of the Hajj tour from the date of departure in Australia until the date of return back to Australia. For any inquiries during the tour, the client must contact his Hajj Group Leader or Imam only.
- You agree to release and forever discharge Adam Travel from any and all actions, causes of action, claims, and demands for, upon, or by reason of any damage, loss or injury, to you and your property which may be sustained in consequence of the losses and expenses as aforementioned.
- Adam Travel or any of their agents, do not accept any responsibility or liability for your acts, omissions, defaults, conduct and state of health condition or circumstances.
- Adam Travel acts only as agent for clients in making arrangements for airlines, hotels, buses or any other services in connection with this tour and assumes no liability whatsoever for: injury, damage, loss, accident, delay or irregularity which may occasionally occur either by reason of defect through the acts or defaults of any company or person engaged in conveying clients or in carrying out the arrangements of the tour, or dangerous incidents in the air, sea, fire, breakdown in machinery or equipment, acts of governments or other authorities, war whether declared or not, hostilities, civil disturbances, strikes, riots, theft , epidemics, quarantines, medical or customs regulations, or from any causes beyond Adam Travel 's control, or from any loss or damage resulting from improper passports, visas or other documents. Adam Travel will accept no responsibility for the loss or additional expenses to delays or changes in schedule or other causes. Adam Travel shall not be liable or responsible for any inconvenience, loss, damage or injury arising in connection with such services. Facilities described in Adam Travel's brochures and/or other marketing material may be withdrawn for reasons beyond Adam Travel's control. Adam Travel will have no responsibility to you or any other party, financial or otherwise, in such cases. Adam Travel will not be responsible for failure to follow instructions, including but not limited to check-in and check - out times and delay, loss of luggage or personal belongings (Medicine). In the event of delay, it is the responsibility of the airlines to determine exactly what procedure will be followed. The policy chosen by that carrier shall be based on its procedures. The policy chosen by that carrier shall be based on their procedure and shall not be the responsibility of Adam Travel and its affiliates. Adam Travel and its affiliates will not be responsible for any person(s) missing any part of the program due to his/her negligence or delay or absenteeism for any time during the tour and will not be responsible for any additional expenses for the participant to re-join the tour.
- Adam Travel acts as a travel agent. We arrange travel services and sell travel related Hajj Packages on behalf of suppliers such as airlines, hotels, transportations, foods, operators, car hirers and accommodation providers. In doing so Adam Travel gives no warranty nor makes any representation regarding the services to be supplied or the Hajj Packages purchased by you. Your booking will be subject also to the terms and conditions applied by the provider of the service or Hajj Packages. You agree that if the travel services or Hajj Packages are not supplied in accordance with your booking your remedy lies with the service provider and not Adam Travel.
- The meals are provided on a self-service basis in Aziziah, Sheesha, Mina and Arafa. You should be aware that the food served is local food and may vary from day to day and Adam Travel cannot be held liable for any impact this may have on your expectations.
- All or any such losses and expenses as aforementioned will be borne by you and will be your sole responsibility to the complete exclusion of Adam Travel.
- You further agree to indemnify and save harmless Adam Travel against and from any and all claims and demands, actions, and claims for contribution or indemnify, whether under any statute or otherwise, which may be made or brought against Adam Travel, including the costs of defence of such action and claim, as any such claims or demands relate to your Hajj Pilgrimage.
- In case you or your agent intend(s) to submit claim against Adam Travel to the courts of Victoria then you or your agent will be liable to pay all the expenses and costs of legal fees, lawyers’ fees, barristers’ fees, Adam Travel staff's fees (Hourly Rates) and damage liability, and you or your agent confirm(s) and agree(s) to pay such costs and fees.
- In case you or your agent fail(s) to pay any outstanding payments to Adam Travel then you or your agent will be liable to face court proceedings in Melbourne, Victoria and all the expenses incurred in such recovery of dues including legal fees, lawyers’ fees, barristers’ fees, and Adam Travel staff's fees (Hourly Rates) who will be involved in such case and damage liability will be borne by you or your agent, and you or your agent confirm(s) and agree(s) to pay such costs and fees.
- Moreover, no upgrades in the program chosen will be the honoured after departure as well as no refund will be given for any services rendered and not utilised.
- Adam Travel will not take any responsibility for ensuring successful booking if these documents are not so received, or are inaccurate, nor will it refund any monies paid in respect of your booking(s).
- When you book a Hajj travel package with Adam Travel, you accept full responsibility for you and your party. If Adam Travel or any other person of authority is of the reasonable opinion that you or a party member is behaving in such a way that is causing danger, distress, upset or damage then Adam Travel reserve the right to cancel the package in respect of the person/party concerned and you and your party must leave any accommodation/transport when told to do so and Adam Travel shall have no responsibility for them including return flights. Please note no refunds will be made and Adam Travel will not be liable for any expenses or costs incurred as a result of the termination. You and your party are entirely responsible for any loss or damage caused to any accommodation and/or transport arranged for you and furthermore are fully responsible to make payments for the same to the service providers, at no point shall Adam Travel be liable for any loss or damaged caused by you.
- You are responsible to maintain acceptable standards of behaviour at all times. You must not behave in any way, which causes or may cause distress, injury or annoyance to others, or give rise or may give rise to the risk of damage to property. If you do behave in any such way, you are likely to be evicted from your hotel. In case of such eviction, the evicting authority’s decision will be final, and Adam Travel will have no liability to you, and will not refund to me any portion of the cost of your package, nor will Adam Travel make alternative arrangements for you.
- Adam Travel reserves the right not to accept customers or bookings (or in exceptional cases to cancel confirmed ones) at our discretion and for whatever (legal) reason without the need to justify such refusal. Typical reasons for rejecting a customer or booking include, but are not limited to: Accommodation request, breach of the Terms and Condition Agreement, force majeure events, trade or economic sanctions, embargoes, legal restrictions, (suspicions of) fraud or theft, suspected criminal activity, suspicious bookings, submission by customer of misleading or erroneous information, credit card problems, inappropriate behaviour, threats, insults, violence, refusal to supply information, practical obstacles, communication problems. In case a booking is rejected or cancelled by Adam Travel and a payment has already been made, you will receive a refund of the total booking value except the deposit payment.
- You are responsible, upon receiving any documentation relating to your booking(s), including but not limited to, flight ticket(s), hotel booking confirmation and transportation confirmation, to ensure that the documents are accurate, and do not contain any errors or omissions. Any errors or omissions must be reported to Adam Travel immediately for rectification. Adam Travel will assume no responsibility for errors or omissions, which are not so reported, nor for any consequences, which flow therefrom.
- You agree to defend, indemnify, and hold Adam Travel, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions Agreement.
- A person who is not a party to these terms and conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these booking terms and conditions. This paragraph does not affect any right or remedy of any person which exists or is available otherwise than pursuant to that Act.
- In case you or anyone in Hajj group intend to submit any kind of complaints against Adam Travel to the Ministry of Hajj or to a court in Saudi Arabia, Adam Travel shall be appointing law companies in both Saudi Arabia and Australia to defend such complaints. Furthermore, in case Adam Travel does not receive any charges from the Ministry of Hajj/Court, you or any person in Hajj group agree and confirm to pay to Adam Travel all the fees and costs of both law companies in Saudi Arabia and Australia including any associated costs (such as wages, airline tickets, hotel accommodation… etc.) which may occur as a result of defending such complaints.
- In case you or anyone as your agent intend to submit any kind of complaints against Adam Travel to any relevant bodies or organizations or to submit a case to any kind of courts in Australia, and as you agreed and confirm that you do not take any kind of legal action against Adam Travel, then Adam Travel shall be appointing law companies in Australia to defend such complaints. you agree and confirm that you the only one to pay to Adam Travel all the fees and costs of law companies in Australia including any associated costs (such as wages, lawyers, barristers, QC, accountants, reports, mediations, court’s fees, airline tickets, hotel accommodation… etc.) which may occur as a result of defending such complaints. Furthermore, all the expenses incurred in such complaints or court’s case including legal fees, lawyers’ fees, barristers’ fees, and Adam Travel staff's fees (Hourly Rates) who will be involved in such case and damage liability will be borne by you or your agent, and you or your agent confirm(s) and agree(s) to pay such costs and fees to Adam Travel.
- It is hereby agreed that You consent to photography, audio recording, interviews, video recording and the release of the same by any means of publication including social media for advertising, or for any other purpose which Adam Travel, our vendors, our partners, our affiliates and/or our representatives deem fit. You release Adam Travel from any liability connected with the same. You waive all rights you may have to any claims for royalties in connection with any exhibition, streaming, web-casting, televising, or other publication of these materials, you have been fully informed of your consent, waiver of liability, and release before joining our group.
- Australian law prohibits the carrying of any foodstuffs when transiting in and out of Australia. It is your responsibility to ensure that you observe this restriction. Adam Travel will not bear any responsibility for your failure to do so.
- Consumer Law
- By using Adam Travel online travel service website you agree that, subject to certain rights and remedies you have under the Competition and Consumer Act 2010 (Cth) and similar State and Territory laws in Australia which cannot be excluded, restricted or modified, neither Adam Travel nor any Adam Travel subsidiary or related company or representative shall be liable for any loss, injury or damage to you or your belongings or otherwise arising in any way out of the provisions of travel services to you and Adam Travel excludes all other conditions and warranties implied by custom, law or statute.
- Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation.
- Adam Travel Pty Ltd and their respective employees, affiliates, officers directors, successors, representative and assignees are not liable and will not assume responsibility for any claims, losses, damages, costs or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from the act or omission of any party.
- This Agreement shall be governed by and construed in accordance with the law in effect in Victoria and the parties hereto accept the jurisdiction of the courts of Victoria in relation to any dispute between them. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any statutory obligation of the Agent implied by the Regulation, the Sale of Goods Act, 1896 or any State legislation if that cannot be lawfully excluded.
- If part or all of any clause of these Terms and Conditions is illegal, invalid, or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
